AASW Social Work Jobs – Terms of Use
Effective date: 1 December 2025
AASW Social Work Jobs is a national program of Australian Association of Social Workers Ltd (ABN 93 008 576 010) (AASW, we, us, our) providing employment solutions via our website at www.aasw.asn.au (Site).
AASW’s [Privacy Policy link] applies to the Site and forms part of these Terms of Use (Terms).
These Terms comprise:
- Part A – Advertiser Terms of Use; and
- Part B – Jobseeker Terms of Use.
By accessing or using the Site, you agree to be bound by the Terms applicable to you.
Part A – Advertiser Terms of Use
1. Definitions
- Advertiser means a potential employer seeking to fill job vacancies and any locum service provider advertising capabilities and capacity for locum-type service contracts on the Site.
- Affiliate means officers, employees, agents, contractors, suppliers and licensors of a party.
- Content means all material on the Site, including text, information, graphics, trade marks, logos, design, layout, downloads, pricing, products and services.
Contract Personal Information has the meaning given in clause 19(e).
2. Account, fees and suspension
2.1 All Advertisers must register an online account.
2.2 Advertisers must pay for services via the Site’s secure payment system or by any other method made available or agreed with AASW.
2.3 If an Advertiser fails to pay as agreed or otherwise breaches these Terms, AASW may disable the Advertiser’s account and refuse to supply further services, without notice.
3. Legal compliance
3.1 Advertisers must comply with all applicable laws and regulations, including the Australian Human Rights Commission Act 1986 (Cth) and all applicable State and Territory anti-discrimination and equal opportunity legislation.
3.2 Where a lawful exemption applies, the advertisement must include the exemption details (legislation and section).
4. Prohibited conduct
Without limitation, Advertisers must not (and must not permit others to):
a) use any automated method (including scraping, robots, spiders or scripted responses) to obtain, process, copy, distribute, reconfigure, republish, assess, analyse, modify or repackage content;
b) use the Site to harm, abuse, harass, stalk, threaten or otherwise offend;
c) frame or mirror any part of the Site without AASW’s prior written consent;
d) circumvent, disable or interfere with Site security; or
e) damage, disrupt or interfere with the proper operation of the Site, or upload any virus or malicious code.
5. Acceptance, removal and termination
AASW may refuse, withdraw or remove any advertisement that breaches these Terms, any law or is inconsistent with AASW’s aims and objectives. AASW may terminate services to an Advertiser that posts such material.
6. Intellectual property
6.1 AASW owns or is licensed to use all intellectual property in the Content. Except as permitted by law or with AASW’s prior written consent, Advertisers must not reproduce, transmit, adapt, distribute, sell, modify, publish or store Content.
6.2 AASW retains all intellectual property rights in goods and services provided to Advertisers.
6.3 Intellectual property in material uploaded by Advertisers is not assigned to AASW. However, Advertisers grant AASW a worldwide, irrevocable, assignable, royalty-free licence (with the right to sub-licence) to use, reproduce, edit, exploit, publish, communicate and otherwise deal with such material for any purpose connected with the Site. Advertisers unconditionally consent to any acts that may otherwise infringe moral rights under the Copyright Act 1968 (Cth) or similar laws.
7. Assignment
Advertisers must not assign or transfer their rights or obligations without AASW’s prior written approval (not to be unreasonably withheld). A change in effective control of a company Advertiser is deemed a transfer.
8. Indemnity
Advertisers indemnify AASW and its Affiliates against all claims, actions, liabilities, costs, damages and expenses arising from:
a) any breach of these Terms by the Advertiser or its Affiliates;
b) any negligent act or omission of the Advertiser;
c) the listing or proposed listing of any advertisement on the Site or related site; or
d) any actual or alleged breach of law in connection with these Terms or the Advertiser’s advertisement.
9. Disclaimers and service availability (Australian Consumer Law preserved)
Without limiting any rights under the Australian Consumer Law (ACL):
a) AASW does not guarantee that files available via the Site or email are free of viruses, worms or other harmful code. Advertisers must maintain appropriate security, back-ups and verification procedures;
b) AASW does not warrant that Site services will be uninterrupted or error-free. We will use reasonable endeavours to remedy disruptions;
c) AASW will not be liable for delays or failures due to circumstances beyond our reasonable control.
10. Cookies
The Site may use cookies for functionality, administration and statistical purposes. Settings can be managed in the browser, but disabling cookies may limit functionality. Non-personal information collected for statistics is aggregated.
11. Publicity
Advertisers must not release any publicity relating to AASW without AASW’s prior written approval.
12. Severability, survival and governing law
If any part of these Terms is invalid, it is severed and the remainder continues in force. Provisions capable of survival will survive termination. These Terms are governed by the laws of Victoria, Australia. Advertisers submit to the non-exclusive jurisdiction of the Victorian courts.
13. Posting and publishing
13.1 AASW uses reasonable efforts to avoid errors but accepts no responsibility for errors in advertisements. Advertisers must promptly review their advertisements and notify AASW of errors; AASW will use reasonable efforts to correct them.
13.2 AASW will use reasonable efforts to publish advertisements promptly but is not liable for any delay or failure.
14. Advertiser warranties
The Advertiser warrants that:
a) it has capacity to enter these Terms;
b) advertisements and other works posted do not contain false or misleading content and do not infringe third-party rights;
c) all files supplied to AASW are free of viruses and malicious code; and
d) it will not use the Site for any illegal purpose.
15. Advertiser obligations and privacy
Advertisers must:
a) comply with all applicable laws (including privacy and copyright);
b) not post or link to pyramid schemes or spam;
c) not ask or require Jobseekers to pay any fee to apply for a job advertised on the Site;
d) not use Site features to send unsolicited emails to Jobseekers; Jobseeker management tools may only be used to communicate about the specific vacancy applied for; resume-database tools may only be used for specific vacancies that match stated preferences;
e) comply with the Privacy Act 1988 (Cth) (including the Australian Privacy Principles), the Spam Act 2003 (Cth) and other applicable privacy laws in relation to personal information obtained via the Site (Contract Personal Information); only use Contract Personal Information as permitted for Site use; comply with AASW’s lawful directions; return or destroy Contract Personal Information on request; promptly notify AASW of any security or privacy breach; and assist AASW with resolving Jobseeker complaints arising from the Advertiser’s breach.
16. Truth in advertising and authority to recruit
Advertisers must adhere to the RCSA Code for Professional Conduct. Advertisements for permanent roles must only be placed where the Advertiser has authority to recruit.
17. Consumer law and fair trading
Advertisements must comply with all applicable laws, including:
a) the ACL (Schedule 2 to the Competition and Consumer Act 2010 (Cth)), including prohibitions on misleading or deceptive conduct and unfair practices; and
b) State and Territory Fair Trading Acts.nar dapibus leo.
18. External application links
Advertisers must not link from AASW’s application process to external sites or application forms without AASW’s prior written approval and agreement to AASW’s linking conditions.
19. Use of resume database and classification
19.1 Advertisers may use the Jobseeker resume database solely to identify Jobseekers whose preferences match current AASW-posted vacancies. Advertisers must not forward a Jobseeker’s resume without permission or use Site content to build their own candidate database.
19.2 Advertisers must post advertisements in appropriate categories. AASW may reclassify or relocate advertisements to another category.
20. New/additional advertisements and bulk import
20.1 Each of the following constitutes a new/additional job advertisement (incurring applicable fees):
- copying a job advertisement;
- reposting an archived or deleted advertisement;
- extending an advertisement beyond 30 days (“renewing”, which may occur multiple times);
- changing zone classification; or
- refreshing an advertisement (deleting and re-posting the same or substantially similar role).
When using bulk data import, changing the job reference number also constitutes a new advertisement.
20.2 Changes to the body copy, title, location, work type, industry or occupation within the existing zone do not constitute a new advertisement.
Part B – Jobseeker Terms of Use
1. General obligations
Jobseekers must:
a) deal with information or products provided by AASW or accessed via the Site in compliance with all applicable laws (including privacy and copyright);
b) not use any Site feature to send unsolicited emails to Advertisers; and
c) not use the Site to harm, abuse, harass, stalk, threaten or otherwise offend.
2. Acknowledgements
Jobseekers acknowledge that:
a) AASW does not control Advertiser-uploaded content and makes no representation as to the quality, safety, standard, truth or accuracy of positions or information posted by Advertisers. Use of such content is at the Jobseeker’s own risk, to the extent permitted by law;
b) Advertisers may access and collect personal information as contemplated in Part A (including resumes made available via the Site); and
c) Jobseekers may be contacted by Advertisers about relevant positions (including via the Site, phone and commercial electronic messages), and consent to such contact.
3. Indemnity and disclaimers (ACL preserved)
Without limiting any rights under the ACL:
a) Jobseekers indemnify AASW and its Affiliates for loss arising from the Jobseeker’s breach of these Terms or wrongful conduct;
b) AASW disclaims liability for loss arising from reliance on information sourced through the Site;
c) AASW does not guarantee that files available via the Site or email are free of viruses or other harmful code; Jobseekers must maintain appropriate security, back-ups and verification procedures;
d) AASW does not warrant that Site services will be uninterrupted or error-free, but will use reasonable endeavours to remedy disruptions; and
e) AASW will not be liable for delays or failures due to circumstances beyond our reasonable control.
4. Intellectual property
4.1 AASW owns or is licensed to use all intellectual property in the Content. Except as permitted by law or with AASW’s prior written consent, Jobseekers must not reproduce, transmit, adapt, distribute, sell, modify, publish or store Content.
4.2 AASW retains all intellectual property rights in goods and services provided.

5. Role of AASW
AASW acts as a medium through which individuals seek employment and advertisers seek employees. AASW does not vet Jobseekers, Advertisers or their representations (including advertisements and resumes), to the extent permitted by law.

- Variations: AASW may amend these Terms from time to time by posting the updated version on the Site. Continued use of the Site after the effective date constitutes acceptance.
- Notices: We may provide notices via the Site, email or your account.
- Entire agreement: These Terms (including the Privacy Policy and any service-specific terms agreed with Advertisers) comprise the entire agreement between you and AASW regarding the Site.
